These Terms & Conditions govern your access to and use of americanbonfireco.com, including purchases, products, content, services, promotions, email communications, SMS/mobile messaging, and other interactions with American Bonfire Co.

This website is operated by American Bonfire Co. Throughout these Terms, “American Bonfire Co.,” “we,” “us,” and “our” refer to American Bonfire Co.

By visiting the Site, placing an order, creating an account, subscribing to emails or text messages, participating in promotions, submitting content, or otherwise interacting with us, you agree to these Terms and all policies referenced in them, including our Privacy Policy, Shipping & Fulfillment Policy, Returns, Exchanges & Warranty Policy, Mobile Terms / SMS Terms, and any promotion, giveaway, discount, or affiliate terms posted by us.

If you do not agree to these Terms, you may not access the Site, use our services, or purchase products from us.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order through the Site. By using the Site, you represent that you are legally able to enter into a binding agreement, are using the Site for lawful purposes, have provided accurate information, and are not prohibited from using the Site under applicable law.

2. Online Store Terms

Our store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

By placing an order, you agree that you are responsible for reviewing your order before submitting it, will provide accurate billing, shipping, email, and phone information, authorize us and our payment processors to charge your selected payment method, and allow us to contact you regarding your order, payment, shipment, delivery, return, exchange, or customer-service issue. We may refuse, cancel, hold, or limit any order at our discretion and reserve the right to refuse service to anyone for any lawful reason.

3. Product Information

We make reasonable efforts to display product descriptions, images, colors, lens details, frame details, materials, packaging, sizing, pricing, and availability accurately. However, we do not guarantee that your device screen will accurately display product colors, lens tint, transparency, finish, or material texture; that product images will be perfectly identical to the physical product; that product descriptions will be free from minor errors, omissions, or updates; or that product availability shown on the Site will always be current.

Product packaging, accessories, materials, specifications, and colors may vary or change without notice.

4. Product Availability

All products are subject to availability. We reserve the right to limit quantities purchased per person, household, account, billing method, shipping address, affiliate, or discount code; discontinue products; modify or remove products from the Site; and refuse, cancel, or limit orders that appear suspicious, fraudulent, abusive, unauthorized, or intended for unauthorized resale.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method, unless otherwise required by law.

5. Pricing, Taxes & Payment

All prices are listed in U.S. Dollars unless otherwise stated. Prices, discounts, promotions, and product availability are subject to change without notice.

You are responsible for all applicable product charges, sales tax, shipping fees, international duties, customs fees, tariffs, carrier fees, payment processing requirements, and other charges disclosed at checkout or required by law.

We reserve the right to correct pricing errors, product information errors, promotional errors, or checkout errors at any time, including after an order has been submitted. If an order is affected by an error, we may cancel the order and issue a refund.

6. Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Site. You agree to promptly update your account and payment information, including your email address, billing address, shipping address, credit card information, and expiration dates, so we can complete your transactions and contact you as needed.

We are not responsible for delays, failed deliveries, misdirected shipments, or order issues caused by inaccurate or incomplete information provided by you.

7. Shipping & Fulfillment

Shipping timelines, processing times, carrier services, delivery estimates, lost package procedures, international duties, and related fulfillment terms are governed by our Shipping & Fulfillment Policy.

Delivery estimates are not guarantees. We are not responsible for carrier delays, customs delays, weather delays, incorrect addresses, refused deliveries, theft after delivery, or events outside our reasonable control. Risk of loss passes to you when the product is delivered to the shipping address provided at checkout, unless otherwise required by law.

8. Returns, Exchanges & Warranty

Return eligibility, exchanges, refund timing, warranty coverage, damaged items, defective items, and final sale restrictions are governed by our Returns, Exchanges & Warranty Policy.

We reserve the right to refuse returns or exchanges that do not comply with our posted policy, including items showing signs of wear, misuse, alteration, damage, excessive handling, missing packaging, or missing accessories.

9. Eyewear Use Disclaimer

American Bonfire Co. eyewear is designed for general lifestyle and sun-protection use unless expressly stated otherwise. Our eyewear is not designed, tested, certified, or intended to be used as safety-rated protective eyewear.

Do not use our sunglasses as protective eyewear for construction, industrial work, tactical use, laboratory work, welding, shooting sports, motor sports, impact hazards, chemical exposure, or any hazardous work or activity requiring certified eye protection.

Our sunglasses are not a substitute for ANSI-rated, OSHA-compliant, or other certified protective eyewear. Using our products outside their intended purpose is at your own risk.

10. Promotions, Discount Codes & Gift Cards

Promotions, discounts, coupon codes, referral codes, affiliate codes, gift cards, giveaways, and special offers are subject to the terms posted with the applicable offer. Unless we state otherwise, discounts cannot be combined, have no cash value, may be modified, suspended, or canceled at any time, and may be limited by product, collection, customer, order value, date, location, or availability.

We may refuse or cancel discounts used improperly, fraudulently, or in violation of these Terms. We also reserve the right to cancel, reverse, or refuse promotional benefits, referral credits, affiliate commissions, or discounts if we determine that the transaction involved fraud, abuse, self-referral, unauthorized resale, artificial traffic, coupon misuse, manual order manipulation, or other conduct inconsistent with the purpose of the promotion.

Gift cards, if offered, are subject to any additional terms provided at the time of purchase or issuance.

11. Affiliate, Referral & Influencer Activity

From time to time, American Bonfire Co. may work with affiliates, ambassadors, influencers, creators, marketing partners, or referral partners. Participation in any affiliate, referral, ambassador, or creator program is subject to separate written terms or platform rules.

We reserve the right to review, reject, reverse, or withhold commissions, credits, discounts, gifts, or benefits connected to fraudulent transactions, canceled or refunded orders, self-referrals, manual order manipulation, unauthorized coupon distribution, misleading advertising, trademark misuse, paid search abuse, cookie stuffing, artificial traffic, orders not properly attributable to the affiliate or partner, or any activity that violates our policies or applicable law.

Nothing on the Site creates a partnership, employment relationship, agency relationship, franchise, or joint venture between American Bonfire Co. and any affiliate, ambassador, influencer, or customer.

12. User Content, Reviews & Social Media Submissions

If you submit, tag, post, upload, email, message, or otherwise provide photos, videos, reviews, comments, testimonials, feedback, ideas, designs, or other content to American Bonfire Co., or if you tag or mention us on social media, you grant American Bonfire Co. a worldwide, royalty-free, sublicensable, transferable, perpetual license to use, reproduce, display, publish, edit, distribute, and create derivative works from that content for marketing, advertising, social media, website, email, product, and promotional purposes.

You represent that you own or control the rights to the content, the content does not infringe third-party rights, the content is accurate and not misleading, the content does not contain unlawful or harmful material, and any individuals appearing in the content have consented to our use of the content.

We may remove, edit, reject, or refuse to publish user content at our discretion. We are not obligated to keep submissions confidential, pay compensation, or respond to submissions.

13. Intellectual Property

All content on the Site is owned by or licensed to American Bonfire Co., including logos, brand names, product names, product designs, product images, videos, graphics, website design, text, packaging, marketing materials, photography, social media content, layouts, icons, trade dress, and other visual or written materials.

You may not copy, reproduce, distribute, modify, display, publish, sell, resell, exploit, scrape, reverse engineer, or use any part of the Site or our content without our prior written permission. Unauthorized use may violate copyright, trademark, trade dress, unfair competition, and other laws.

14. Prohibited Uses

You may not use the Site, our products, our content, or our services for any unlawful purpose; to violate any federal, state, local, or international law; to infringe intellectual property rights; to submit false or misleading information; to interfere with Site security or functionality; to upload viruses, malware, or harmful code; to spam, phish, pharm, pretext, crawl, scrape, spider, or use automated tools without authorization; to collect or track personal information of others; to harass, abuse, defame, threaten, intimidate, or discriminate; to engage in promotional abuse, affiliate abuse, coupon abuse, or resale abuse; to impersonate another person or entity; or to interfere with or circumvent security features of the Site.

We reserve the right to terminate or restrict access to the Site for any prohibited use.

15. Third-Party Services, Tools & Links

The Site may use or link to third-party platforms, tools, applications, websites, payment processors, analytics providers, marketing platforms, review platforms, shipping providers, and other services. These third parties may include Shopify, payment processors, shipping carriers, email/SMS providers, analytics providers, advertising platforms, review platforms, and fulfillment providers.

We do not control and are not responsible for third-party websites, platforms, tools, services, errors, delays, outages, policies, content, or practices. Your use of third-party services may be subject to their own terms and privacy policies.

16. Privacy

Your submission of personal information through the Site is governed by our Privacy Policy. By using the Site, you acknowledge that you have reviewed our Privacy Policy and understand how we collect, use, disclose, and protect personal information.

17. Email, SMS & Marketing Communications

By subscribing to our email or SMS programs, you consent to receive promotional and transactional communications from American Bonfire Co. Consent to marketing communications is not a condition of purchase. Message and data rates may apply for SMS/MMS messages. Message frequency may vary.

You may unsubscribe from marketing emails by using the unsubscribe link in any marketing email. You may opt out of SMS messages by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any SMS message from us, or by using any other reasonable method that clearly communicates your request to stop receiving text messages.

After opting out, you may receive one additional message confirming your opt-out request. We will process opt-out requests in accordance with applicable law. For help, reply HELP to any SMS message or contact us at hello@americanbonfireco.com.

Our SMS program may be subject to separate Mobile Terms, which are incorporated into these Terms by reference.

18. Mobile Messaging Terms

If you opt in to our SMS/MMS mobile messaging program, you agree to receive recurring text messages from American Bonfire Co. at the mobile number provided. Messages may include promotional offers, product launches, cart reminders, order updates, shipping updates, customer-service messages, and event or brand announcements.

Message frequency varies. Message and data rates may apply. Mobile messages may be sent using automated technology where permitted by law. Consent is not required as a condition of purchase.

You represent that you are the account holder or authorized user of the mobile number provided. If you change, transfer, or stop using that number, you agree to opt out or notify us.

Wireless carriers are not liable for delayed or undelivered messages. SMS/MMS delivery is subject to transmission from your wireless provider and is outside our control.

If you are a Florida resident, certain additional rules under the Florida Telemarketing Act and Florida Do Not Call Act may apply. We may use information such as your shipping address or phone number area code to identify Florida residents for compliance purposes.

19. Errors, Inaccuracies & Omissions

Occasionally, information on the Site may contain typographical errors, inaccuracies, omissions, or outdated information related to product descriptions, product images, pricing, promotions, discounts, shipping charges, transit times, availability, specifications, inventory, or order details.

We reserve the right to correct errors, inaccuracies, or omissions at any time without prior notice, including after an order has been submitted. We may update information, cancel orders, adjust pricing, or refuse fulfillment if information on the Site is inaccurate.

20. Disclaimer of Warranties

Except as expressly stated by us in writing, the Site, services, content, and products are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, durability, title, non-infringement, accuracy, reliability, and availability.

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free; that Site errors will be corrected; that product information will always be complete, accurate, or current; that products will meet every customer expectation; or that the Site or servers will be free from viruses or harmful components.

Some jurisdictions do not allow limitations on implied warranties, so some limitations may not apply to you.

21. Limitation of Liability

To the fullest extent permitted by law, American Bonfire Co. and its owners, officers, directors, employees, contractors, affiliates, suppliers, service providers, licensors, partners, and agents shall not be liable for any indirect, incidental, punitive, special, exemplary, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, business interruption, shipping delays, delivery failures, product misuse, website interruptions, unauthorized access, errors or omissions, or losses related to third-party services.

Our total liability for any claim arising out of or relating to the Site, products, services, or these Terms shall not exceed the amount you paid to American Bonfire Co. for the specific order giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

22. Indemnification

You agree to indemnify, defend, and hold harmless American Bonfire Co. and its owners, officers, directors, employees, contractors, affiliates, suppliers, service providers, licensors, partners, and agents from and against any claims, damages, losses, liabilities, costs, expenses, and attorneys’ fees arising out of or relating to your breach of these Terms, misuse of the Site, misuse of our products, violation of law, violation of third-party rights, content you submit to us, or fraudulent, abusive, or unauthorized activity connected to your account, order, payment method, discount code, referral code, or affiliate activity.

23. Termination

These Terms remain effective unless terminated by either you or us. You may stop using the Site at any time.

We may suspend, restrict, or terminate your access to the Site, cancel orders, refuse future service, or deactivate accounts if we believe you have violated these Terms, engaged in fraud or abuse, or created risk for American Bonfire Co., our customers, our partners, or our systems.

Any obligations or liabilities incurred before termination shall survive termination.

24. Force Majeure

We shall not be liable for delays, failures, or inability to perform caused by events outside our reasonable control, including natural disasters, weather events, fire, flood, labor disputes, supply-chain delays, carrier delays, customs delays, government actions, war, terrorism, pandemics, power outages, internet outages, platform failures, or third-party service interruptions.

25. Dispute Resolution, Arbitration & Class Action Waiver

Attorney review strongly recommended before publishing this section.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our products, services, marketing communications, or your relationship with American Bonfire Co. shall be resolved through binding individual arbitration, except that either party may bring an individual claim in small-claims court if the claim qualifies.

Arbitration shall be administered by JAMS under its applicable rules and shall take place in Napa County, California, unless the parties agree otherwise or applicable law requires another location.

You and American Bonfire Co. agree to resolve disputes only on an individual basis. You waive any right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding to the fullest extent permitted by law. You and American Bonfire Co. waive the right to a jury trial.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, or prevent unauthorized use of the Site or brand assets.

If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in effect to the fullest extent permitted by law.

26. Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Site, our products, or our services shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to the arbitration provision above, any permitted court proceeding shall be brought in the state or federal courts located in Napa County, California, unless applicable law requires otherwise.

27. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed from these Terms. The remaining provisions shall remain valid and enforceable.

28. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by American Bonfire Co.

29. Entire Agreement

These Terms, together with all policies and terms referenced in them, constitute the entire agreement between you and American Bonfire Co. regarding your use of the Site and purchase of products.

These Terms supersede any prior or contemporaneous agreements, communications, proposals, or understandings, whether oral or written. Any ambiguities in these Terms shall not be construed against the drafting party.

30. Changes to These Terms

We may update, change, or replace any part of these Terms at any time by posting updates to this page. The “Last Updated” date reflects the most recent revision.

Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
